Education & Migration Agents on Visa extension during Covid-19

During Covid-19 how you can extend your stay in foreign country? Get the Registered Migration Agents and Education Consultants guide on the Visa extension during Covid-19.

Immigration businesses around the world had come to a grinding halt in the past one and a half years. It is a long wait for offshore applicants waiting for international flights to resume. Things, however, can keep you wary if you fail to address pivotal issues continuously weighing on your mind. Follow due procedures of education and immigration consultants if you are a first-time applicant stuck onshore.

Across the globe, many countries have imposed travel restrictions on individuals who want to enter the country for study and work purposes. In reality, the country's visa operations have remained down since the start of the pandemic. You could be an overseas student on a subclass 500 student visa, a graduate with a subclass 485 Temporary Graduate Visa, a tourist visa holder, or a skilled professional, all looking for an extension of their visas during the coronavirus pandemic.

It is, however, a positive sign if you are an onshore applicant.

But, who can travel? If you are its citizen, a permanent resident, and a New Zealand citizen, you can travel to Australia. Covid-19 pandemic and travel ban have not deterred hopes of individuals planning to study, work and settle in the country.

The travel ban is applicable for Subclass 491 Skilled Work Provisional Visa holders who are not permanent residents.

List of procedures applicants have to follow

Subclass 500 Student visa

It comes in handy for an international student who wants to extend a student visa (subclass 500) but is stuck overseas due to the pandemic. Students cannot return to their home country as their courses are incomplete and require more time.

The fact of the matter is that if you are one of these students, you have to go for an extension. Renew the visa application three weeks before the expiry of the student visa. No need to show proof as the immigration authority is aware of the impending pandemic issue. If your student visa is bound to expire, you can apply for an Australian visitor visa-subclass 600. You have to take into context several issues in advance before the expiry of subclass 500.

Subclass 485 Temporary Graduate Visa

Applicants cannot stay in Australia as their Temporary Graduate Visa (subclass 485) expired. You cannot get a visa extension if you want to prolong your stay and cannot overstay. If you are overseas currently, you have one-year time to apply for Temporary Residency (TR).

Visitor Visa and Tourist Visa holders
Applicants whose tourist visa or visitor visa is expiring cannot travel to their country. Before the current visa expiry date, you need to apply for a new one. Besides, you cannot extend your stay nor breach any conditions.

Working holiday visa applicants
Similarly, working holiday visa holders cannot apply for a Tourist visa if they are in Australia. Due to the pandemic, they can apply for a visa onshore.

Unable to meet English test and medical & police check criteria
Over 16 months passed by from the time the pandemic began. With Australia's shutdown and travel ban, non-essential businesses such as Biometric and English Test centers have been closed. Applicants have to stay calm and wait till further notice from the immigration authority.

No Further Stay
The condition of No Further Stay prohibits every visa holder from the time they are applying for temporary as well as permanent visas while they are staying in Australia. Besides, you can comply with different 8503, 8534, and 8535 conditions. In case of extending stay in Australia, you can apply for another visa or the same kind of a further visa.

If you are on Condition 8503
If one of the 8503 conditions is attached to the visa, you will not be allowed to apply for protection or a temporary visa of a particular kind if you are in Australia. Take the help of Registered Migration Agents and Education Consultants Australia familiar with the Australian immigration and visa procedures.

However, 8503 is mandatory for different visas such as:
- Visitor Visa Subclass 600 (Sponsored Family Stream)
- Visitor Visa Subclass 600 (Stream of Approved Destination)
- Visitor Visa Subclass 600 (Tourist Stream) in case there is a sponsorship imposed on it
- Subclass 402 Training & Research Visa for professional development stream
- Subclass 462 Work & Holiday visa in case you held two 462 visa subclasses

However, you cannot apply for Australian visas other than subclass 866 Protection Visa.
If you are on Condition 8534
It is a discretionary condition on a student visa. The 8534 applies to subclass 500 applicants and family members. The case officer assesses it while scrutinising your application.

If you are on Condition 8535
It is a mandatory condition for student visa applicants sponsored by the Department of Home Affairs and Trade, and the Department of Defence.

With the help of the condition, you will not be allowed to apply for another visa apart from
- Protection Visa
- Subclass 500 visa supported by sponsoring government agency
